A torture trial in Calgary has come to an abrupt halt as both sides prepare for a key legal argument.
Presentation of evidence in the Dustin Paxton case concluded Tuesday after eight weeks of testimony and 50 witnesses.
But defence lawyer Jim Lutz served notice that he wants a judicial stay of proceedings due to the late disclosure of evidence and the handling of a Crown witness.
If Lutz is successful, the trial will be terminated.
Justice Shelagh Martin met with lawyers Wednesday and set the matter over to Nov. 29.
Paxton, who is 31, was charged with aggravated assault, forcible confinement and sexual assault after a former friend and business partner was dropped off at a Regina hospital in April 2010.
The alleged victim was battered, bruised and severely malnourished.
