OFFICIAL RULES AND REGULATIONS

                                                                                                                                                           

 

1.   The Athlete of the Week contest (the “Contest”) is sponsored by Bell Media Inc. and SUBWAY Restaurants (hereinafter referred to as the “Contest Sponsors”).  The Contest starts at 9:00 a.m. Central Time (“CT") on December 28, 2015 and closes on December 17, 2016 at 12:00 p.m. CT (the “Contest Period”).  There are twenty-four (24) prizes (the “Prizes") to be won.  No purchase necessary.  Void where prohibited.  Limit of one (1) Prize per Nominee (defined below).

 

2.   ELIGIBILITY:  To nominate a Nominee, you (the “Nominator”) must be a legal resident of Saskatchewan residing in either the CTV Saskatoon and CTV Prince Albert television viewing areas (the “Northern Region”) or the CTV Regina and CTV Yorkton television viewing areas (the “Southern Region”) (collectively, the “Regions”), as determined by the Contest Sponsors at their discretion, and be eighteen (18) years of age or older.  In order for a Nominee to be eligible to be entered into the Contest, he/she must be a legal resident of Saskatchewan residing in one of the above Regions.  Important Note: Each Nominator must obtain prior written consent from his/her Nominee (or his/her parent or legal guardian if a minor) and provide proof of same to the Contest Sponsors upon request, to enter the Nominee into the Contest.  Employees and their parents, siblings and children, and persons domiciled with an employee of the Contest Sponsors, their respective agents, parent, affiliated or related companies, subsidiaries, divisions, prize sponsors, and promotional and advertising agencies and administrators, are ineligible to enter.  Nominees under the age of majority are eligible to win a Prize provided that the parent or legal guardian of such Nominee accepts any such Prize and the terms and conditions hereof for and on behalf of such Nominee. 

 

3.   HOW TO ENTER: Nominators residing in the Northern Region can enter the Contest during the Contest Period by visiting the website located at www.ctvsaskatoon.ca (the “Northern Region Website”), clicking on the Contest page and completing and submitting an entry by following the instructions found on the Contest page.  Nominators residing in the Southern Region can enter the Contest during the Contest Period by visiting the website located at www.ctvregina.ca (the “Southern Region Website”), clicking on the Contest page and completing and submitting an entry by following the instructions found on the Contest page.  The Northern Region Website and Southern Region Website shall be referred to collectively herein as the “Contest Websites”.  Entries must include: (i) Nominator’s full name, address, age, telephone number, email address; (ii) the full name of the person being nominated by the Nominator (the “Nominee”) and the Nominee’s address (including the Region as described above), telephone number and age; (iii) one (1) original video (the “Video”) of the Nominee performing an athletic skill at the amateur level in accordance with the Submission Requirements provided below; and (iv) one (1) original photograph (the “Photo”) of the Nominee in accordance with the Submission Requirements provided below (the Video and Photo shall collectively be referred to as the “Submission”); and the Nominee will automatically be entered into the Contest.  Important Note: Each Nominator must obtain prior written consent from the Nominee (or his/her parent or legal guardian if a minor) and provide proof of same to the Contest Sponsors upon request, to submit and enter the above information and Submissions of the Nominee into the Contest.

 

Limit of one (1) entry per Nominee and per Nominator during the Contest Period.  If it is discovered by the Contest Sponsors (using any evidence or other information made available to or otherwise discovered by the Contest Sponsors) that any person has attempted to: (i) exceed the foregoing limit on entries; and/or (ii) use multiple names, identities, email addresses and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or to disrupt this Contest; then he/she may be disqualified from the Contest in the sole and absolute discretion of the Contest Sponsors.  An entry may be rejected if (in the sole and absolute discretion of the Contest Sponsors) the entry is not fully completed with all required information and submitted and received in accordance with these official rules and regulations (the “Rules”) during the Contest Period.  The Contest Sponsors are not responsible for late, lost, misdirected, delayed, incomplete or incompatible entries (all of which are void).  All entries are subject to verification at any time and for any reason.  The Contest Sponsors reserve the right, in their sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Contest Sponsors – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any entry or other information entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason the Contest Sponsors deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with these Rules.  Failure to provide such proof to the complete satisfaction of the Contest Sponsors within the timeline specified by the Contest Sponsors may result in disqualification in the sole and absolute discretion of the Contest Sponsors.  The sole determinant of the time for the purposes of this Contest will be the Contest server machine(s).  The Contest Sponsors reserve the right to reject and disqualify any entry if they discover that any information provided is either false or fraudulent (as determined by the Contest Sponsors in their sole and absolute discretion).  In the event of a dispute, entries shall be deemed to be submitted by the "Authorized Account Holder" of the email address submitted at the time of entry. "Authorized Account Holder" is defined as the natural person who is assigned to an e-mail address by an internet access provider, on-line service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted email address.

 

By entering a Submission into the Contest, each Nominator authorizes Bell Media Inc. to post his/her Submission to the Contest Websites and/or broadcast the Submission on CTV at the sole discretion of Bell Media Inc.  Bell Media Inc. will initially screen every Submission.  Any Submission that Bell Media Inc. deems, at any time, violates the terms and conditions set forth in these Rules, as determined by Bell Media Inc. in its sole and absolute discretion, will be disqualified.  Prior to being posted on the Contest Websites and/or broadcast on CTV, Bell Media Inc. reserves the right, in its sole and absolute discretion, to edit or modify any Submission, or to request a Nominator to modify, edit and/or re-submit his or her Submission, in order to ensure that the Submission complies with the terms and conditions set forth in these Rules or for any other reason. 

 

4.   PRIZES: There are twenty-four (24) Prizes to be awarded (each, a “Prize”). Each Prize consists of one (1) Subway Gym Bag, one (1) Subway Water Bottle, one (1) Subway Frisbee and one (1) $50 Subway Cash Card.  In addition, the Submission entered into the Contest by the Nominators of the Prize winning Nominees may be featured in a segment broadcast on CTV on a date and time determined by Bell Media Inc. at its sole discretion at no compensation to the Prize winning Nominees or such Nominators.  Approximate retail value of each Prize is $100 CAD (the segment feature has no retail value).

 

5.   Prizes must be accepted as awarded.  Prizes may not be sold, transferred and are not convertible to cash. Contest Sponsors reserve the right to substitute a Prize in whole or in part in the event that all or any component of a Prize is unavailable. Prize winners are solely responsible for all costs not expressly described herein.

(each, a “Qualifier Selection Date”), two Videos will qualify for entry into a Prize Draw (described below) as follows: (1) all eligible Videos received during the Contest Period from Northern Region entries will be judged and assigned a score by a group of judges (the “Judges”) selected by the Contest Sponsors at their sole discretion, on the basis of the following criteria: (i) athletic skill; (ii) entertainment value; and (iii) video quality (the “Criteria”).  The Nominee of the Nominator whose Video obtains the highest score (as determined by the Judges in their sole discretion) will be deemed the potential Northern Region Athlete of the Week (the “Northern Region Qualifier”) and will qualify for entry into a Prize Draw described below; and (ii) all eligible Videos received during the Contest Period from the Southern Region entries will be judged and assigned a score by the Judges on the basis of the Criteria.  The Nominee of the Nominator whose Video obtains the highest score (as determined by the Judges in their sole discretion) will be deemed the potential Southern Region Athlete of the Week (the “Southern Region Qualifier”) and will qualify for entry into a Prize Draw (the Northern Region Qualifier and Southern Region Qualifier shall collectively be referred to as the “Qualifiers” and each, a “Qualifier”).  In the case of a tie, the Video (in each Region as applicable) that scored highest on video quality will be deemed the potential Qualifier.  The odds of becoming a Qualifier will depend on the number and caliber of eligible entries received in the applicable Region during the Contest Period and the quality of the Video associated with each entry in the applicable Region on the basis of the Criteria. The decisions of the Judges shall be final and binding.   

 

7.   PRIZE DRAWS:  On each Prize draw date set out in the chart below (each a “Prize Draw”) at approximately 1:00 p.m. CT, a random draw will take place at CTV Saskatchewan from among the Qualifiers chosen in each Region during the Qualifier Selection Dates set out in the chart below.  The first Qualifier drawn from among the Qualifiers received in each Region during the Qualifier Selection Dates will be eligible to win a Prize.

The odds of a Qualifier winning a Prize will depend on the number of Qualifiers received in each Region during the applicable Qualifier Selection Dates.  Bell Media Inc. will attempt to contact each potential Prize winner by telephone within two (2) business days of the applicable Prize Draw.  If a potential Prize winner cannot be contacted within two (2) business days of the applicable Prize Draw, he/she will be disqualified and the Contest Sponsors reserve the right, in their sole and absolute discretion, to select the Video that received the next highest score as the potential Prize winner (in which case the foregoing provisions of this section shall apply to such new potential Prize winner). 

 

      In order to be declared a Prize winner, each potential winner (or his/her parent or legal guardian in the case of a minor) must first correctly answer, unaided, a time limited mathematical skill testing question administered by Bell Media Inc.  Before being awarded a Prize, each potential Prize winner (or his/her parent or legal guardian in the case of a minor) will be required to sign and return within the time stipulated by the Contest Sponsors, a full release and indemnity form stating, among other things, that: (i) he/she has read and understood these Rules; (ii) grants all consents required; (iii) agrees to be available and to participate in publicity and/or promotions related to the Contest and/or the Contest Sponsors and/or similar matters; (iv) authorizes the Contest Sponsors to broadcast, publish, disseminate and otherwise use his/her name, city/town/village and province/territory of residence, photograph, likeness, sobriquet and voice, in connection with any promotion and/or publicity, and/or for general news, entertainment and/or information purposes at no additional compensation to the potential winner, beyond the awarding of or participation in the Prize; (v) accepts the Prize as offered; and (vi) releases the Contest Sponsors from any and all liability of any kind arising out of the potential winner’s participation in this Contest and receipt and use of the Prize. In the event that that a potential Prize winner does not comply with all the provisions as contemplated in these Rules, Contest Sponsors shall have the right at their sole discretion, to disqualify such potential winner and to select the Video that received the next highest score as the new potential Prize winner (in which case the foregoing provisions of this section shall apply to such new potential Prize winner) and the Contest Sponsors shall be fully and completely released and discharged from any liability or responsibility in this regard. The provisions and procedures referred to above relating to selection and notification of a potential winner shall be applied, with the necessary amendments, until all qualified winners have been duly selected.

 

8.   SUBMISSION REQUIREMENTS:

 

(a)    Each submitted Video must: (i) be of the Nominee performing an athletic skill at the amateur level.  Any Video containing footage of a professional athlete will be disqualified; (ii) be no more than 30 seconds in length and not exceed 5MB in size; and (iii) portray a safe athletic activity.

(b)    Each submitted Photo must be of the Nominee only.

(c)  Submissions must: (i) not infringe copyright or other intellectual property rights of any third party; (ii)not contain any identifiable third party products and/or trade-marks, brands, logos or copyright. For example, any clothing worn by a person(s) in the Submission must not contain any visible or identifiable logos, trade-marks, names or other third party materials; and (iii) be suitable for publication (i.e. must not be obscene or indecent, depict violence, discriminatory or derogatory behaviour) as determined by the Contest Sponsors at their sole discretion.

 

Contest Sponsors reserve the right, in their sole and absolute discretion, to disqualify any Submission that they believe is offensive, inappropriate, illegal, potentially or actually dangerous or harmful or containing any element of physical risk, defamatory, obscene or otherwise not in keeping with the spirit of the Contest.

 

By submitting a Submission, Nominators represent and warrant that: (i) each individual included in the Submission (or his/her parent or legal guardian if such individual is a minor) has as of the time of submitting the Submission, agreed that the Contest Sponsors and their respective agents can use, exploit, and distribute in any media whatsoever, including, without limitation, the Internet and on television, now known or hereafter created, worldwide in perpetuity, his/her likeness, image, voice, and comments as they appear in the Submission (as applicable) without any further consent or compensation. Any Submission that involves a third party that does not consent to be part of the Submission will be disqualified.  Nominators will be required to provide Contest Sponsors with written proof of consent from third parties appearing in the Submission in a form acceptable to the Contest Sponsors upon request, failing which the Nominator and his/her Submission will be disqualified. Contest Sponsors assume no responsibility for any claims against infringement of the right of privacy with respect to any Submission submitted.

 

      In addition, by entering the Contest and submitting a Submission each Nominator: (i) represents and warrants that his/her Submission complies with these Rules; (ii) agrees to release the Contest Sponsors, their respective parent companies, subsidiaries, affiliates, prize suppliers and advertising/promotion agencies and each of their respective employees, agents, officers, directors, successors and assigns (collectively the “Releasees”) from any and all claims, damages, liabilities, costs, and expenses arising from any liability in connection with this Contest and his/her participation therein; (iii) agrees to indemnify the Releasees against any and all claims, damages, liabilities, costs, and expenses arising from use of his/her Submission including, without limitation, any claim that his/her Submission infringes a proprietary interest of any third party; and (iv) irrevocably grants to the Contest Sponsors, in perpetuity, a universal, non-exclusive, royalty-free, sub-licensable and transferable license to use, reproduce, distribute, prepare derivative works of, display, adapt, reformat, translate, and otherwise exploit and perform all or any portion of the applicable Submission for any purpose whatsoever, including, without limitation, in connection with: (a) the Contest, including, without limitation, promotion and redistributing part or all of the Contest (and derivative works thereof) and any future similar contests; (b) third party public viewing galleries, as selected by the Contest Sponsors at their sole discretion; (c) social media websites, as selected by the Contest Sponsors at their sole discretion; and (d) the Contest Sponsors’ network of Internet websites, wireless applications, interactive television, broadcast media (including, without limitation, on television on CTV), video on-demand and any other media or technology (including, without limitation, Internet protocol, wireless or interactive platforms or interfaces) through which the Contest Sponsors distribute content to end users, whether now existing or hereafter developed (the “Platforms”), in any and all media formats and through any and all media distribution and advertising and promotional purposes, without accounting, notification, credit or other obligation to the Nominator (collectively, the “Licence”).  For the avoidance of doubt, without limiting the generality of the rights granted to the Contest Sponsors, the Licence includes, without limitation, the absolute right to edit and/or alter any Submission, to distribute and synchronize all or any portion of the applicable Submission in timed relation to any other visual elements; to web cast, pod cast, re-publish, re-broadcast, re-platform, port, syndicate, route, and link to and from all or any portion of the applicable Submission; to encrypt, encode and decode, and compress and decompress all or any portion of the applicable Submission; to edit, mix, combine, merge, distort, superimpose, create or add special effects, illusions and/or other material to or of all or any portion of the applicable Submission; to create composite, stunt, comic or unusual photographs, videos, animations, motion pictures and/or voice reproductions from all or a portion of the applicable Submission; and to excerpt and/or extract portions of the applicable Submission in order to host, store, index, categorize and display the applicable Submission on or through the Platforms. Each Nominator that submits a Submission specifically waives any and all moral rights and/or any and all integrity rights in and related to his/her Submission and agrees to evidence same in writing if requested by the Contest Sponsors. Each Nominator that submits a Submission agrees to complete and sign all documents necessary to confirm and/or give effect to the rights granted herein. Each Nominator that submits a Submission acknowledges and agrees that Contest Sponsors will not be held liable for any third party copying, sharing, re-posting or unlawful use of his/her Submission. 

 

GENERAL CONDITIONS:

 

9.       By entering this Contest the entrants and participants automatically agree to accept and abide by these Rules. All decisions of the Contest Sponsors and Judges with respect to any aspect of this Contest are final and binding on all entrants and all participants in all matters as they relate to this Contest.

 

10.   The Contest Sponsors assume no responsibility for garbled, lost, late, delayed, destroyed or misdirected entries, Videos, mail, voice messages, email or any computer errors or malfunctions. No correspondence will be entered into except with entrants requesting Rules by mail or requesting the names of the Prize winners (for which a self-addressed, postage paid envelope must be included). Contest Sponsors do not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, seeding or printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software or any combination thereof. Entry materials or data that have been tampered with or altered are void. If for any reason, in the opinion of the Contest Sponsors, in their sole discretion, the Contest is not capable of running as originally planned, or if the administration, security, fairness, integrity or the proper conduct of the Contest is corrupted or adversely affected, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond its control, Contest Sponsors reserve their right to cancel, terminate, modify, amend, extend or suspend the Contest, and select a winner from previously received eligible entries. Contest Sponsors reserve their right to modify the Rules without materially affecting the terms and conditions hereof. The Contest Sponsors reserve their right in their sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of the Rules or otherwise in a disruptive manner. Any attempts to deliberately damage the Contest Websites or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made the Contest Sponsors reserve its right to seek remedies and damages to the fullest extent of the law. Contest Sponsors shall not be held responsible for any errors or negligence that may arise or occur in connection with the Contest including any damage to an entrant’s computer equipment, system, software or any combination thereof, as a result of their participation in this Contest or from downloading any material from the Contest Websites.  

 

11.   Contest is subject to all applicable federal, provincial and municipal laws and regulations. By entering this Contest each entrant consents to the collection, use and distribution of his or her personal information (information that identifies an entrant as an individual, such as home telephone number, age and home address) by the Contest Sponsors for the purposes of implementing, administering and fulfilling this Contest. Contest Sponsors will not sell or transmit this information to third parties except for the purposes of administering this Contest.  By entering the Contest, entrants consent to the manner of collection, use and disclosure of personal information as set out in Bell Media Inc.'s Privacy Policy, which is available at bellmedia.ca/about/Media_Privacy.page. Any inquiry concerning the personal information held by the Contest Sponsors should be addressed to Bell Media Inc. at 216 First Avenue North, Saskatoon, SK, S7K 3W3.

 

12.   In the event of any discrepancy or inconsistency between the terms and conditions of the Rules and disclosures or other statements contained in any Contest related materials, including but not limited to the Contest entry form, or point of sale, television, print or online advertising, the terms and conditions of the Rules shall prevail, govern and control. 

 

13.   All intellectual property, including but not limited to trade-marks, trade-names, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans and representations are owned by the Contest Sponsors and/or their affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.

 

LEGALS for the Athlete of the Week Contest

 

No purchase necessary.  Contest starts at 9am CT December 28, 2015 and closes on December 17, 2016 at 12pm CT. Open to legal residents of Saskatchewan, residing in either the CTV Saskatoon and CTV Prince Albert television viewing areas or CTV Regina and CTV Yorkton television viewing areas who are 18 years of age or older. Some restrictions apply.  Correct answer to a mathematical skill testing question required.  Approximate retail value of each Prize is $100 CAD.  Odds of becoming a Qualifier will depend on the total number and calibre of eligible entries received in the applicable Region during the Contest Period and quality of the Video associated with each entry on the basis of the judging criteria.  Odds of a Qualifier winning a Prize will depend upon the total number of Qualifiers received in each Region during the applicable Qualifier Selection Dates.
