A judge has declared a mistrial in the case of a Regina man accused of killing his mother.

The defence applied for the mistrial after realizing a page of notes was missing. The notes, written by an officer, stated that someone had claimed the victim's boyfriend, Lindsay Bigsky, had allegedly threatened her.

Bigsky has been represented by the office of the defence in the past and, therefore, it could not ethically represent James Myers in this case.

Myers is charged with second-degree murder in the May 2013 death of 46-year-old Rachel Shepherd, whose body was found inside an apartment building in the city.
